    Arrested at 16

    I was just arrested today because apparently i had a warrant for a felonie out for me...the warrant was placed on Jan 31st 2004 and I was taken in on friday march5th 2004...the crime was graffiti on school property and was written as taken place on August 3rd 2003....I was pulled over while working(i deliver food for a chinese place) because my back tail light was out...after about 30 minutes he came back and asked me to get out to see my back taillight...he showed it to me and asked me to step to the right just a little and then he grabbed my arm and i pulled back and he said that he could easily throw me on the ground...i had no idea what was going on and demanded to call my parents and asked what was happening....he said i knew what was going on and then asked me my age...i told him i was 16 and that i wanted to talk to my parents....he called them using my cell phone and my dad knew about the graffiti but we were lead to believe that everything was dropped and over with bc we never heard about anything else...so here i am sitting in the back of the car and my parents rolled up pissed at the cop...they didnt show any signs of disrespect though...my dad took my car and my mom drove back home to follow him...another officer comes to take me to juvy and the first cop realized what a miss this all was allowed me to have the cuffs in the front of my body...he thanks me for cooperating...and is on his way....the female cop takes me downtown to get paper work then i go to juvy...juvy said they couldnt hold me at all bc of when it all took place...and they said i did good job at running from it all...but in all i never knew i had this against me...

    i just want to know if they are suppose to give me a chance to turn my self in...bc if that was the case i would of done it jan31st...

    Just because you don't hear anything means things were dropped. They might have mailed a court date in the mail. Mail gets lost all the time. Unfortunately, while you are innocent until proven guilty, it is still your burden to find out what is going on with your case. The DA has far too much to do to send out personalized updates on your charges beyond a court appearance notice. You cannot be found innocent unless you show up to court. It sounds like you, for whatever reason, didn't show. And why would they have to give you notice of a warrant? It is an arrest warrant...some courts are generous about letting traffic offenders know and giving them a chance, but generally with felons, you don't get that leeway. I would get a lawyer...a GOOD one.

    Well now at least you know that things you do and consequences don't disappear just like that .... Like stated before ... because you don't hear from a situtation never means it disappear.... Take care of your buisness till the end...

    Good luck with your case... and be good boy from now on.... You can only learn from this and move on hoping(and making sure yourself) this will never happen again !!!!

    In Florida graffiti to any church or place of worship is a felony of 3rd degree.
    Also if graffity exceeds the amount of $1100(I believe, I might be wrong thou) it is a felony of 3rd degree.
    Otherwise it is misdeamenor.

    Depending on the amount of damage (over $1000 in Calif.), it can be a felony. Perhaps the officer wanted to scare you.

    On a different topic, I found it very hard to read and understand your story. No offense, but I am not impressed by your writing skills. I think all of us would be more than happy to give you our opinions of your situation; that is if we could read what the situation actually was. Could you rephrase your story in a matter that is more consistant with standard english?

    Thanks, and good luck with Juvenile Hall. They are pretty intense here in the Bay Area, sometimes worse than the County and City lockups.

    § 3307. Institutional vandalism.
    (a) Offenses defined.--A person commits the offense of institutional vandalism if he knowingly desecrates, as defined in section 5509 (relating to desecration of venerated objects), vandalizes, defaces or otherwise damages:

    any church, synagogue or other facility or place used for religious worship or other religious purposes;
    any cemetery, mortuary or other facility used for the purpose of burial or memorializing the dead;
    any school, educational facility, community center, municipal building, courthouse facility, State or local government building or vehicle or juvenile detention center;
    the grounds adjacent to and owned or occupied by any facility set forth in paragraph (1), (2) or (3); or
    any personal property located in any facility set forth in this subsection.

    (a.1) Illegal possession.--A person commits the offense of institutional vandalism if, with intent to violate subsection (a), the person carries an aerosol spray-paint can, broad-tipped indelible marker or similar marking device onto property identified in subsection (a).

    (b) Grading.--An offense under this section is a felony of the third degree if the act is one of desecration as defined in section 5509 or if the actor causes pecuniary loss in excess of $5,000. Pecuniary loss includes the cost of repair or replacement of the property affected. Otherwise, institutional vandalism is a misdemeanor of the second degree
