You need an attorney. Only real idiots represent themselves. With an attorney, you are more likely to negotiate a plea with the prosecutor that will have the least impact on your future. There are a ton of lesser charges to which you could plead "no lo." But, in the meantime - close out the post by acknowledging that while you didn't steal it, you were thinking about it.

3. You must see the shoplifter conceal or carry away your merchandise
4. You must maintain continuous observation the shoplifter
5. You must see the shoplifter fail to pay for the merchandise
6. You must approach the shoplifter outside of the store

That sounds like the standard policies that most merchants or retailers follow, but as far as I know (I'm not LE), the moment you concealed the item under your shirt you were done. I expect to be corrected if am wrong. I currently work Loss Prevention for a retail store, and we typically follow the steps you've listed to avoid ANY type of defense such as the "creative" one that you've described. Regardless, I hope you have learned something from your actions and move on in a positive direction.Originally Posted by jep
