    legal issue

    Hey,
    I am a resident of Califronia. I have a question about excessive use of force and unlawful detention!
    Couple days ago,i get kicked out from local mall because i wear my hood inside the mall, their reason is you can not cover your face with anything, which means do not cover your face.
    Today, i went to the mall with hood on but never covered my face, but they still kicked me out. They claim i am "DISTURBING THE PEACE".I follow the instruction of the security guard and leave the mall area, and head to my car. All the sudden, a new security guard show up and ask me to sit down to wait for his boss to come and talk to me. Me and my two other friends sited down for about two mins, the boss comes all crazy and handcuffed without single explaination. After all this, i realize the situation is against me, not just normal procedure. He took me to his SUV and put me inside while many people were watching and wonder what happen. They took down my information and released me about twenty minutes later.
    Question is :
    1. Am i "DISTURBING THE PEACE" because i wear a hood inside mall?
    2. While i am following their instruction, they decide handcuff me in the parking lot not inside the mall where the situation happen, is that excessive use of force since i did not do anything may cause danger?
    3. Does security guards have the rights put me in the back of the car, i wonder is this unlawful detention?
    4. What should i do if excessive use of force and unlawful detention are proved?

    You need to talk to a lawyer. IF you were complying with instructions, etc., you might have a civil case.

    I feel as if there is something else missing like you ran out a store with the hood up or something. Are you sure you are telling us everything? We can not give you the advice you ask for if you leave something out. Your attorney is going to want to know everything because the security guards are going to have a different version I guarantee that.

    I wouldn't even grace this with a serious response because we're hearing one side of the story from a guy that sounds like an outstanding contribution to society. In most states security can arrest/detain for a LEO. He was kicked out once for wearing his hood, then decides to show up again and wear the hood. I think security could easily articulate a trespass charge. I'm also sure there are quite a few details missing from this. I have a word for guys that wear hoods inside of a warm building - thug.

    The mall is private property. If they've already asked you to leave once, and you come back you can be arrested for trespassing.

    You apparently are no longer welcome there and they no who you are. The best advice would be not to go back there.

    Im curious what your behavior was like that got you banned from a frikkin mall. You do realize that thousands of people shop there every day and never have contact with security- however you manage to actually get kicked out TWICE.

    Slow learner. It's their property- play by their rules, or don't play. Play by your rules and you will probably end up locked up soon.
