Hey everyone, have a lawyers ofc hounding me to pay $800 plus in back HOA dues and legal fees. Haven't paid due to no amenities in neighborhood, no enforcement of covenants and recently financial hardship due to my business failing. New section of our neighborhood in the back is exempt from paying dues, some deal worked out by the developer of that area that was added a few years after our section was built. Just looking for some advice if anyone has any.

IMO, all civil but you might be SOL. I'm no expert but to me it's similar to not paying rent because you've got an annoying faucet drip or because you experience power outages a couple of times a week. It is my impression that you have quite a few hoops you need to jump through before you stop paying - and even then, stopping payment might not be a legal option either...

They'll end up taking you to court and probably getting a judgment against you. But it's all civil. I'd try to settle it before it gets to that if I were you. But at any rate, you're gonna need a lawyer at this point.

Your failed business has no bearing. As for lack of amenities....attend the meetings and find out where your money is going.
Does the HOA agreement GUARANTEE the amenities ? Is their any relief in the agreement for their non-performance ?
I,ll suspect that it doesn't permit no payment , just that you can sue them. You probably have to send them a formal letter and go to meetings to ask for them to formally do something etc , have you done ANY of this ?
