Lets say a man is on the street. There is another man there with a gun. Can the cops shoot the man with the gun?

If it's realism you want for your story you have the cops secure the area but not engage the gunman because it goes against every rule in the "Book." Luckily, play-by-his-own-rules-book-be-damned Detective Jack "The Jackhammer" Hammer is on the scene and he's ready to take care of business. The Jackhammer never keeps a round in the chamber of his weapon, so everytime he draws he has to pull back the slide and make that cool ka-ching sound. Have him yell to the gunman over a bullhorn that's he's only going over to him to talk. He hands his weapon over to his partner (who's three days away from retirement, mind you) and walks over to the gunman unarmed. Once The Jackhammer confronts the gunman, twin semi-autos pop out from underneath his shirt sleeves and proceeds to send the gunman to the morgue.
