ummmm.... if they have warrant don't you HAVE to take them to jail??? lol.. I can't even imagine half the stupid stuff you guys and gals hear from people...I get it enough in my profession too I've come to conclusion that there are two types of stupid...scary stupid & silly stupid...with people. I prefer the silly stupid I have more patience for them

I have yet to get anyone with a warrant from another state where they actually want them. I guess I don't deal with REAL criminals.

That's because you don't border California. We get a lot of gang bangers from the LA area trying to blend in up here. Washington is pretty good about extraditing too even if they're warrants aren't for as serious crimes.

I had a guy with one out of South Dakota one time. That's one of those states you forget exists lol...
The warrants havent been for anything too hardcore though...

I stumbled across a guy wanted for murder in Florida once when he was caught by Sear security for shoplifting. I guess he thought if he went diagonally across the country.......
We used to get wanted people from the South. A lot of Southerners came to Oregon during WWII to work in the shipyards. I guess their wanted relatives came here to live with them and hide out.

So say someone gets stopped in Florida and they have warrant for their arrest in Ga, Ga has to come get them??? I always thought a warrant was a warrant it did'nt matter where it was from the person was arrested right then ...so that's interesting..to know.. lol not that I have a warrant or anything but I just never knew that

Putting it very simply, you have to be tried in the state (and county) where you are charged.

Personally, I think there should be a federal law requiring agencies to extradite if they put the warrant info in NCIC.

I agree.
I've hooked someone up with a California warrant all the way down here in Florida. Georgia is horrid IMO for extraditing people. I have yet to arrest someone on a Georgia warrant. I've ran across numerous ones for serious felony's (drugs, burglaries, grand thefts, etc) and Georgia won't extradite. Always "Only within state". Guess the figured out the best way to keep crime low, issue a warrant and only extradite from within the state. Push them off to other states. Ultimate trespass warning "Don't come back to Georgia or you are going to jail". lol

I guess I'm understanding it right if you stop someone with a out of state warrant either that state has to come get them or the people get off the hook?? if that's so I never knew that, crime is crime regardless of where it's commited IMO...interesting....

98% of the warrants are for violations of state laws. One state can't prosecute someone for breaking the law in another state. Think of it as you violating a Portland, Oregon city ordinance in Tampa, Florida. Each state's laws are specific only to that state.

Warrants are issued by a certain judge, in a certain county, in a certain state. Therefore when the person is picked up on that warrant they need to be returned to that particular state and county to face their charges at whatever step they were at when the warrant was issued in the first place.
If the originating jurisdiction doesn't want to extradite you aren't off the hook because it doesn't clear the warrant. They never go away.

I can't speak in generalities but I know there are counties in arizona that won't even come get in state warrants. they set a mileage limit. I guess it's the modern day equivalent of being driven to the county line and told not to come back.

We have some like that in Florida, however I don't know if it's due to a mileage limit. It's usually petty crimes, and they will say when we run them "Will extradite surrounding counties only". I've even seen a few that say in county only.

yeah but if they never return to the state/county of the charges and the people never come get them then they never really get charged, well they already have a warrant but they don't do the punishment I guess is what i'm trying to say...I can understand them having to be charged in the state where the crime was committed but it just seems like the other state should HAVE to come get them....and it not be considered a option??? but then again who would pay for all that transporting b/c I'm sure a lot of them run..well I know they do you would be a dummy to stay in the same state with a warrant lol...

I guess technically yes, but each time the warrant pops up it has to be confirmed, at any given time when they get picked up you could decide to extradite...

Most of our fail to appears for misdemeanor or traffic are either in county only, or our county plus the other county in this judicial district.

Got out with a guy who had a warrant in GA for Vehicular Homicide, they wouldn't extradite. Crazy.

You get charged and therefore tried in the area where the crime was committed. Imagine if you live in Illinois and while you were on vacation in Disneyland, you broke some Illinois state law, how silly it would be if Illinois tried to charge and try you. And you are correct, if I come in contact with someone who has an out of state warrant, my dispatch has to check to see if they will extradite, meaning come and get him. If so, I hook him / her up and take them to jail. If not, inform them of the warrant and say "Have a nice night." The crime was still committed wherever it was committed, but the agency issuing the warrant has decided they do not wish to spend the $$, time, and resources to come get the criminal from wherever they are.
I've never hooked one on an out of state warrant, but I have picked people up for other Florida counties and taken them in and placed a hold on them.
I've had a lot of CA in state only. I always want to call BP and have them relay the bastard in past Yuma ...
