Does anyone know whether or not North Carolina Probation Officers are considered Law Enforcement Officers? Specifically persuent to HR 218 and NC State Concealed Carry provisions.


The only thing I can find is a recognition of NC P/O's as 'Criminal Justice Officers' under North Carolina law, but not specifically called 'Sworn Law Enforcement Officers' in any codified provisions. NC P/O's, under their NC Code, have the authority to arrest probation and parolees, and also have the same authority of a deputy sheriff in the performance of their duties (stated in the NC Code).


Conducting some basic google searches on the topic turns up information on the weapons they carry and authority, and forum posts by folks who state they are NC P/O's, which indicate that departmental policy stipulates they turn their weapons in at the end of the night, but the department does not specifically stipulate no off-duty carry, and that their are no provisions for qualifications for off-duty carry.


Just trying to see if they are covered or not. One thing I found made it sound like they could potentially carry under HR 218, but not under NC Concealed Carry provisions. So carrying concealed in their own state (with their own non qualified firearm), would be under federal provisons, rather then state provisions.

as far as i know they are considered leo's, everytime they come to my station for "hoe dad tuesday" they are carrying weapons. considering some of their clientel i would think they must be able to carry concealed off duty.

I know two Federal Probation Officers in NC for both the Statesville & Charlotte areas. Coincidentally, they also both worked as NC Probation Officers before entering Federal Probation. Well in their statute they are stated as folks that are exempt from state carry laws at it applies to state buildings *their offices, court houses, police stations, Jails(?), etc. But it never mentions anything about their standing off-duty.

I'm a PPO II in NC, and we can carry our weapons while on duty anywhere we go the same as any LEO, but when off duty, we cannot carry our state issued weapons, and must have a concealed permit to carry our own weapons. I hope this helps!

Was passed and signed by Gov Dumpling this July and will be effective 1 Dec 2011. SO as of Dec Probation/Parole Officers can carry concealed off duty without a Concealed Carry Permit but the Dept of COrrection will not allow Officers to carry State Issued Weapons off duty.

Finally Starting to get some respect.... also in the bill is adding us to the definition of Law Enforcement Officer (at least for this law)
