The pennsylvania federal gun law questionaire when you go to buy a gun clearly states no one who couldve been sentenced to a max prison term of a year is permitted to purchase a gun and also those i believe with mental illness.At least that was the questions when i bought my gun years ago.
But my brother who is on prozac for deppression and has had a conviction for misdemeanor battery in florida was allowed to purchase.The law in florida clearly states the max prison sentence is a year for misd battery,and no it wasnt domestic.Now,he has had nothing on paper about his deppression or regarding the law besides his physciatrist but he has been suicidal before.My family and i are worried.We went to the gun store where he bought the gun and they gave us no info besides the purchase was legal according to the check which is done by the feds or psp i believe.My family and i are very worried any info on why he was permitted to purchase and what we can do regarding having the purchase pulled would be appreciated.
Background checks aren't perfect. Contact the PSP barracks in your area and speak to a criminal investigator.

I contacted psp they told me the sale was perfectly legal.Saying that the misdeamor charge he recieved in florida was not sufficeinte enough for a dq.They said the charge has to exceed a max prison term of 365 days in prison.Which the max sentence he couldve recieved was 365 days.And id have to go to court to try and get his registartion revoked.So if the the state police says its legal i guess its not a mistake,right ?

The MAX sentence he could have gotten was 365 days.
The restriction begins at a sentence of over 365 days.
Bottom line is he is ONE DAY on the good side of being legal.

The question on the registration almost contradicts itself.My brother said he asked whether it was legal to the gun shop owner if he could say said no on the ? and he said it was o.k as long as the prison term wasnt over 365 days are they allowed to help you like that.?

The gun owner did not tell him to lie about it. He simply clarified the question from what I can understand. There is nothing illegal about that.
And there is no gun registration in PA.... However the sale of the gun was legal. Just because someone has depression doesn't mean they are going to harm themselves or someone else. Theres a very VERY wide range of what depression is.
The " battery" could have been spitting on someone, hardly a reason to take away a constitutional right dontcha think?

Yes but if you know the question on the form it does kind of contradict itself.

Gun permit or whetever you go through in p.a buying your first gun.But will all due respect officer you dont know my brother.Hes so far managed to not get arrested for all the drugs hes done and other things but i have no doubt in my mind he doesnt care about himself or others.Especially law enforcement.He hates hates cops with a passion.Hes said stuff to the affect of i wanna kill me a cop before i die and hes not one of those morons whose gonna just pull my gun out so they can shoot me first im gonna catch them off guard.And then hel just kill himself.This is half my families fault too.I wanted to call the police when he tried to kill himself.And i have no doubt he indeed wanted to kill himself.He did a bundle of heroin and slit his wrists the right way.I wanted to call the police to get him commited but my brother talked my mom into not calling the police telling her there gonna send him upstate and hed get all these charges and fines and it would ruin his carrer.Im still not sure the purchase was legal.Its says a max sentence of a year.Either way he carries it on him at all times and he doesnt have a conceal carry permit.So i just hope he gets it taken away asap or before someone gets hurt.
So are you now READY to do something about this ? You tell us all of thses bad things he has done and all of the bad things he might or wil do but are you ready to DO something ?
When you KNOW hew has it , cana describe the make and model if not caliber and where he has it on him and is out in public....CALL THE POLICE.
