If the cop was doing it, it's a safe bet that he CAN. BTW: Where the officer was has absolutely no bearing on whether you broke a traffic law.:rolleyes:

Absolutely not! Cop cars are inanimate objects and they do not have hands, therefore lack the ability to hold onto the actual radar gun. It's left up to the Officer who is inside the car.

I would venture to guess so. Many cops, myself included when I was in patrol, utilize private property to run traffic/radar. I've sat in church parking lot, dirt roads, paved driveways, and various other spots, and don't recall anyone every having a problem with it (i.e. the owners of the property). I'm sure if I were blocking their ability to leave for work in the morning that might be cause for frustration and me having to move, but if you're asking if it's legal (and hence, the ticket given be valid) for a cop to park in a private property spot to work traffic, the answer is yes.

We can sit on private property and run RADAR. It's not an issue and not grounds for the ticket to be dismissed.

I would be happy to let them set up shop in my driveway, and I'd probably even bring them out a cup of coffee to thank them for keeping my neighborhood safe for the families who live here. Grow up, pay the ticket, and slow down.

Yup, I do it all the time. Sometime's homeowners have such a problem with speeders in their area, they'll INVITE me to sit in their driveway to run radar.

People can ask the offiicer not to sit on their private property and they have to leave. But that has nothing to do with the speeder that got the ticket.

I think rather than doing that, I'd be more likely to plant bushes he could easily hide behind... for some reason though, no cops seem to want to hide in our drive... wonder if it has anything to do with 5 cars an hour being like rush hour (unless it's harvest time), or just because it's a dirt road... hmmm... :p

Nope, the officer lied to you when he issued you that ticket.
Radar only operates when on public property.
Not on private property.
Set a court date and tell the judge.
He will fix it for you.

Also suponea the GPS records for the radar.
It will prove to the judge that the radar was
on private property at the time.
