I am from Wisconsin and I was wondering if cop can give Disorderly conduct ticket for excessive acceleration on private proptery, well if it can hold up even with out the owners concsent meaning owner would like the ticket dropped, the ploice officer took it apon him self to issue it with out consent of the owner.

happend at gase station that friend of mine owns never left the presonal proptery of my freinds land.

thanks for honest answear, what happend was that i was backing up i have a camaro z28, and i ended up chippering the wheels cop was pulling into the lot and then pulled me over.

NYSVTL is enforceable on all public property, and alll private property that is open to the public (parking lots).

In Virginia you would be charged with Reckless Driving...even if the owner gave you consent to being on the property. The owners of the property can't consent to you driving recklessly.

I'm sorry this is just my personal opinion. Anyone who names a car model, especially a sports car: and cries about getting an exhibition of speed type ticket should go jump off a bridge in that car.

Apparently they can or the Officer wouldn't have done it.

Your friend can appear but it really won't do any good. Most gas stations are corporate owned, and the Prosecutor will probably exclude his testimony before it gets that far anyway.

wouldnt Excessive acceleration be exaftly that acceleration if there is no forward to revers movment then theres no acceleration which there wasnt i didnt even get out of the parking stall like i said i put it into reveress and the tires chripped..

as for coperate actully the gase station is privately owned guy owns all gase stations in this town.
along with majority of them in srounding town..

i put to gethere some written letters statments from people saying that i never left parking stall and that i did not accelerat above zero mphs
i would have thought at most i could get one for Excessive Noise ? becuase under my countys ordance secition 66-2 no preson shall make unnecesarry and annoying nose with a moter vehicle by squealing tires, excessice acceleration of engine, or by emitting unnecessary and loud muffler noises any preson biolating any provision of this section shall upon conviction forfiet not more then 200$

well like i said ticket i got is for 300$ and its based on exessive acceleration whcih i can not find any where unless as an ordance for city or for county.

im thinking about just going to judge thats over the case and just ask him, presonal.
I dont care if i get the ticket as much as for getting it for the right thing if im getting it cuz i squeeled my tires then fine wha ever, but if im getting it for something elese then..

what exactly is excessive acceleration so far it seems really vague to me.

Acceleration: It doesn't matter in what direction of travel you happen to be going. Regardless of direction of travel, if you wern't slowing down, than you were speeding up or maintaining a constant speed. Deceleration is when one is to decrease the velocity of one's movement. From what you were saying, you clearly wearn't doing that.

In Maine:

§2079. Unnecessary noise

Braking or acceleration may not be unnecessarily made so as to cause a harsh and objectional noise. [1993, c. 683, Pt. A, §2 (new); Pt. B, §5 (aff).]

Can a cop issue a discon summons for excessive acceleration on private property?

NYS Penal law has a subdivision for excessive noise, and all discon violations have to be performed "in public view".

It's also a violation to be in posession of small amounts of marijuana in NY. Does that mean if a property owner gives you permission to do so, that it makes it legal?

Wisconsin Statutes, 947.01

Disorderly conduct. Whoever, in a public or private place, engages in violent, abusive, indecent, profane, boisterous, unreasonably loud or otherwise disorderly conduct under circumstances in which the conduct tends to cause or provoke a disturbance is guilty of a Class B misdemeanor.

This statute does not require a victim...State v. Vinje, 201 Wis. 2d 98, 548 N.W.2d 118 (Ct. App. 1996), 95-1484.

Looks like it fits the bill to me.

The judge won't accept your written statements, they aren't admissible. Your witnesses will have to appear in court so they can be cross examined by the Prosecution.

Make sure your friend has money with him to pay fine,I don't see him beating this charge unless its a liberal judge!
