Im kind of new here and dont really know much. I've tired searching to see if anyone else had this problem, but I couldnt really find anything. Sorry if posting in the wrong area.

The thing is last night I got a speeding ticket. The officer told me I was doing 90, but he wrote 95 on the ticket. The speed limit was 40 mph.

What am I in for?

Im 18 years old and attend college.

Not sure where you are at, but I am with sbrad. Anything over 20 and I can take you to jail and make you post bond on the ticket. And at 55 MPH over the limit, you would have been going to jail no matter if it was your first or fifth ticket....

In my area, you are looking at a couple of hundred dollar fine plus 3 days in jail.

I've got one more question if I may.

If I do get a fine I have to pay it full right there? What if I dont have enough? . jail? Would I be able to come back and pay the rest?

Most places will let you pay off the fine as you are able to because they want the revenue.

Where did you get the ticket at and by whom?

From looking at the maps, and considering the speed you were doing, it probably took him that length of time to catch you up and pull you over. Can't really see you having any defence that will stand up.

Why is it that the speeders expect us to pull them over immediately? Did you ever consider that he might have been letting you proceed to an area that was safe for the traffic stop? Or that he might have been running your plates to see if you have any warrants/suspensions? OR even possibly, that it took that long for him to catch up with you (I guess not really in your case, Thomas, but it happens to me)

Another thing, just because you though you weren't speeding at the spot you saw the officer doesn't mean he/she didn't see you well before that.

You got a lead foot. You got caught, and it seems like you got quite a break. More than 40MPH over would get your d/l suspended in NY, and the cop might even arrest you for Reckless Driving. You can try to "make a case" but if I was the cop who wrote you, and I was notified that you were fighting the summons, you can bet I would have all my t's crossed and i's dotted and ready for court. You might be able to see if you can plea bargain down to a lesser speed, but it looks like you got your gift already. Good luck, speed demon. :)

Mods: I know its traffic related, but wouldn't this be better suited for ask-a-cop?

He didn't pull you over until like a half mile down the street because you were driving NINETY-FIVE MILES AN HOUR. It likely took him that ling to catch you. Plead guilty and pay the fine. No one here is going to give you advice on how to get out of a ticket. Just be glad that you didn't go to jail and your car didn't get impounded. Be very glad that you didn't kill yourself or an innocent motorist.

From reading some of the stuff on the CA pages about speeding (google is your friend son) you maybe able to go to traffic school. Ask for that, pay your fine, and be thankful you didn't go to jail.....

Seriously though, you need an attorney. Not because you have any chance of contesting the charge, but because you need someone who might be able to beg you a favor and try to get the charge watered down.

I am sure you heard it a couple times already but if you couldn't remember how fast you were driving down the street you obviously were speeding and hence you deserve the ticket. Luckily you did not hurt or kill someone in the process; but you should of been arrested. Be an adult admit your mistakes pay the fine and learn from it. You got off easy!

At 90 mph a half mile only takes a few seconds. We can pull you over whenever we want. If we want to wait for backup to get closer, a better spot on the side of the road, a stolen vehicle check to come back, whatever. It doesn't matter.

It doesn't matter if you can read the officer's handwriting as long as he can read it and tell the judge and the clerk.

It doesn't matter what you remember about how fast you were going as long as the officer's equipment is properly calibrated and documented (it is.)

Not sure on that, at least here in the Midwest. Anything this high over the posted limit is deemed reckless driving, thus no court supervision and/or driving class. It's basically a mandatory ticket..unless you hire a lawyer and plead out.

You need an attorney. This is a very serious offense and you could possibly lose your license (if CA is anything like VA, I will not pretend to understand CA code). An attorney might be able to get a deal cut for you.

Not that you deserve one, but hey, that is what I would do if I were in your shoes.

Plead guilty, dress smart and take what comes like an adult.

Sir, I insist upon my constitutional right to be pulled over immediately. ;)

There's a SCOTUS case from a while back in which the court says that you do not have a constitutional right to be arrested. I forget what the petitoner's logic was, but something about being detained and then released. He argued that he should have been either arrested or released. It is an older case. Pre-Terry as I recall. Damn, I wish I could remember the name. But I always got a chuckle out of the fact that I do not have the right to be arrested. Not that I would ever argue that I do have that right, obviously.

Yes, you have no right to a speedy arrest - so basically I'll dangle the warrant in front of you a few times a day for a year or so then arrest you when you look like you are having a good time.

I'm very familiar with that location/area. Telegraph Rd separates Pico Rivera sheriff station (North) from Downey PD (South). Further West is Montebello PD and across the 605 (East) is Whittier PD (Pico station also handles unincorporated areas of Whittier).

I don't recognize that officer's name or number as being LASD. I'm thinking he's one of the other 3 or CHP (5 and 605 being so close). Which one was it?

Also what section(s) were you cited for? At over 2x the limit, I'd be extremely surprised if you will be allowed to attend traffic school...

You haven't said what you were cited under, but you'll notice if it was just for speed, you'll be looking in the infraction section towards the top. If for reckless, you'll have to scroll down to the misdemeanor section. 95 in a 40? I would have charged you reckless, arrested you, and towed your car. You've already gotten off lucky, you probably shouldn't press your luck in court.

I am amazed that you can arrest on a speeding ticket. I'm a LEO in PA and I have written people for 109 in a 55 and all I can do is give them the max speed citation and maybe push a Driving at a safe speed citation. All they get for going that fast, if they plead guilty, is points on their license and a departmental hearing. Although, I would like to be able to arrest for speeds that fast. The funny thing is, the guy I got going that fast stated "109?, i thought i was only going 90". Remind you its a 55 mph zone. :rolleyes:

Yes, we can arrest drivers for doing 20MPH and above and make them post bond on the ticket ($200.00 or their driver's license). Plus, as per Department SOP, we will have the vehicle towed from the scene. We use the same tow operator and he works well with us. He will make the registered owner come get the car....not the driver of it if it was a different person. That would suck if you were out of state.....but that's life.
He charges $50.00 for the tow plus storage fees.

I know the county judge will give 3 days in jail when a person is found guilty for going over a 100MPH. That and a hefty fine.

We can get people banned from driving for going over 100 on our motorways, still doesn't seem to be much of a deterrent as many still do it!
