My cousin came over to my house the other night, and i took his truck out in my backyard and did doughnuts. The cops got called but they took a couple hours to get there. My husband and I got into a bit of an argument so he went out and sat in his truck. The cops showed up about the driving reckless. My cousin told them it was him because he didn't want me to get into trouble. But I told the cops it was me. Now they never read him his rights and would not use my statement. They ended up taking him to jail to give him an alcohol test. He blew a .075%. Now my question is, how on earth did they get him for an OVI when he was only sitting in his truck because of my husband and I. And I clearly admitted to driving reckless in my yard.

You need to ask the agency/officers who made the arrest...

I already did the night he was taken in. The officer said he already admitted to driving. But I told him it was me. And how can he even use anything my cousin told him when he never read him his rights. I thought that's when statements can be used right?

He only needs to be read his rights if they ask him questions after he was arrested. Anything he said when the officers first got to the scene will be admissible.

You don't need advice from cops on this, you need to talk to a lawyer who specializes in DWI cases.

Reckless driving in my area is one of only two traffic charges that can be enforced on private property and is defined as driving in a manner that endangers life or property. The other is OWI.
